Terms of Service

By registering for an account, you confirm that:

• You have read and agree to these Terms
• You agree to our Privacy Policy and Cookie Notice
• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement

If you are accessing ELA Map on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

ELA Map collects and stores sensitive personal data — including birth date, birth time, and birth location — and is designed for adult users. By creating an account, you confirm you are 18 or older. If we become aware that a user is under 18, we will close their account and delete all associated data without notice.

Registration

To use ELA Map, you must create an account using either your email address and a password, or by signing in with Google. You agree to provide accurate information when registering and to keep it current.

Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@elamap.com.

One account per person

Accounts are personal and non-transferable. You may not share your account credentials with others or allow others to use your account.

ELA Map offers several ways to access features. All pricing is displayed at elamap.com/pricing, which is the authoritative source. We reserve the right to update our pricing with at least 30 days' advance notice via email and a notice within the app.

Free tier

A free account gives you access to a defined set of features. We reserve the right to adjust what is included in the free tier at any time, with reasonable notice where practical.

Mid-tier one-time purchase

Some features are available as a permanent one-time purchase. Once the feature is unlocked and delivered to your account, the purchase is complete. One-time purchases are non-refundable after the feature is unlocked. If you believe there is a technical issue preventing access to a purchased feature, contact support@elamap.com.

If you delete your account, you lose access to features unlocked via one-time purchase. One-time purchases are tied to your account and cannot be transferred or reinstated on a new account.

Pro subscription

Pro is a recurring subscription that gives you full access to ELA Map. Billing details — including cycle length and pricing — are listed at elamap.com/pricing.

Auto-renewal: Your Pro subscription renews automatically at the end of each billing cycle. We will send you a reminder before your first renewal. You can cancel at any time through your account settings. Cancellation takes effect at the end of your current billing period — you retain full access until then.

Refund policy for Pro: If you are not satisfied with Pro, you may request a full refund within 14 days of your initial subscription payment by contacting support@elamap.com. After 14 days, subscription payments are non-refundable. Refunds are not available for renewal charges once they have been processed — if you want to avoid a renewal charge, cancel before the renewal date.

PDF reports

Individual PDF reports are available as per-item purchases. Delivery is considered complete when the report is available in your ELA Map account or delivered to your registered email address, whichever comes first. PDF reports are non-refundable once delivered. If you experience a technical failure that prevents delivery, contact support@elamap.com within 7 days of purchase.

Payment processing

All payments are processed by Stripe, Inc. ELA Map does not store your payment card information. Your card details are handled entirely by Stripe under their own PCI-compliant systems. By making a purchase, you also agree to Stripe's terms of service and privacy policy.

Your own chart

When you create an account and set up your birth chart, you provide personal information — including your birth date, birth time, and birth location. This information is stored securely in your account and used to power ELA Map's features. See our Privacy Policy for full details on how this data is handled.

Saving charts for other people

ELA Map allows you to save charts for people other than yourself — for example, a partner, family member, or friend. When you do this, you are entering that person's personal information into our systems.

By saving a third-party chart, you represent and warrant that:

• You have that person's consent, or
• You have a legitimate and lawful basis under applicable privacy law to enter their information, and
• You will delete their chart from your account if they ask you to

You are solely responsible for ensuring you have appropriate authorization before saving another person's data. Spirit River is not responsible for any claims arising from your unauthorized storage of third-party personal data.

What sharing does

ELA Map allows you to share chart views via a link or exported image. Shared links allow anyone with the link to view that chart snapshot — no ELA Map account is required to view a shared link.

What shared content may include

A shared chart link or image may include the chart subject's name, birth date, birth time, and birth location, depending on the chart and your sharing settings. Before sharing a chart for another person, you are responsible for obtaining their consent.

No public profiles

ELA Map does not have publicly discoverable user profiles. Sharing is intentional and link-based — your charts are not browsable by other users.

Link availability

We make reasonable efforts to keep shared links available, but we do not guarantee their permanence. ELA Map reserves the right to disable or expire shared links at any time, including where a link is being used in violation of these Terms or where we receive a valid takedown request.

This content is not medical, psychological, psychiatric, legal, or financial advice. It should not be relied upon when making significant life decisions. ELA Map makes no claims or guarantees about future events. Astrological interpretation is not a substitute for qualified professional advice in any field. Past astrological patterns are not a reliable predictor of future outcomes.

Nothing in ELA Map's content is intended to diagnose, treat, cure, or prevent any medical or psychological condition.

You agree to use ELA Map only for lawful purposes and in accordance with these Terms. You must not:

• Use ELA Map to upload or share content that is unlawful, harmful, or violates another person's rights
• Attempt to gain unauthorized access to any part of ELA Map's systems or another user's account
• Use automated tools to scrape, crawl, or extract data from ELA Map
• Reverse-engineer, decompile, or disassemble ELA Map (except to the extent permitted by applicable law)
• Use ELA Map to harass, threaten, or harm any person
• Misrepresent your identity or affiliation when using ELA Map
• Use ELA Map for any commercial purpose not expressly permitted by these Terms

We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice depending on the severity of the violation.

ELA Map may incorporate open source software components. Where applicable, the licenses for those components are honored. Nothing in these Terms limits rights granted under applicable open source licenses, including any decompilation rights afforded under the EU Software Directive (Directive 2009/24/EC, Article 6) or equivalent provisions under applicable law.

Our content

ELA Map, including its design, features, branding, and original content, is owned by Spirit River Inc. or its licensors. You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

Your content

You retain ownership of any content you create in ELA Map (such as chart labels or notes you add). By using sharing features, you grant ELA Map a limited, non-exclusive license to display and transmit that content as needed to operate the sharing functionality.

Feedback

If you send us feedback or suggestions, we may use them freely without obligation to you.

You can leave at any time

You can delete your account at any time from your account settings. Deletion removes your account, all saved charts (including any third-party charts), birth data, and associated content. See our Privacy Policy for retention timelines after deletion.

We may terminate your account

We reserve the right to suspend or terminate your account if you violate these Terms, or for any other reason at our reasonable discretion, with notice where practical. If we terminate your account without cause, we will refund any unused prepaid subscription fees on a pro-rated basis.

ELA Map is provided "as is" and "as available." To the fullest extent permitted by applicable law, Spirit River Inc. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that ELA Map will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any astrological content provided through ELA Map.

Some jurisdictions do not allow the exclusion of implied warranties. If you are a consumer in one of those jurisdictions, some of these exclusions may not apply to you.

To the fullest extent permitted by applicable law, Spirit River Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — arising out of or related to your use of Ela Map.

Our total aggregate liability to you for any claims arising under these Terms will not exceed the greater of (a) the total fees you paid to ELA Map in the 12 months before the claim arose, or (b) USD $100.

These limitations apply regardless of the legal theory of the claim and even if we have been advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless Spirit River Inc. and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of:

• Your use of ELA Map in violation of these Terms
• Your storage or sharing of third-party chart data without appropriate authorization
• Your violation of any applicable law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Informal resolution first

Before initiating any formal proceeding, you agree to contact us at legal@elamap.com and give us 30 days to attempt to resolve the dispute informally.

Binding arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or your use of ELA Map will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will take place in Delaware or, at your election, via video or telephone. The arbitrator's decision is final and binding.

Class action waiver

Small claims exception

Either party may bring an individual claim in small claims court if it qualifies under the court's jurisdictional rules.

EU and UK consumer carve-out

If you are a consumer located in the EU or UK, nothing in this section prevents you from bringing a claim in the courts of your country of residence or exercising rights under applicable consumer protection law. EU and UK consumers are not required to submit to arbitration.

We may update these Terms from time to time. When we make material changes, we will notify you by email and display a notice within the app at least 30 days before the changes take effect. Your continued use of ELA Map after the effective date of updated Terms constitutes acceptance. If you do not agree to updated Terms, you may close your account before the changes take effect.

Entire agreement. These Terms, together with the Privacy Policy and Cookie Notice, constitute the entire agreement between you and Spirit River Inc. regarding ELA Map.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.

Assignment. You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.

Force majeure. Neither party will be liable for delays or failures caused by circumstances beyond their reasonable control, including natural disasters, government actions, or infrastructure outages.

Notices. Legal notices to Spirit River Inc. should be sent to legal@elamap.com. We will send notices to you at the email address associated with your account.
